El arbitraje es una actividad de naturaleza jurisdiccional y se define como: Un procedimiento por el cual se somete una controversia por acuerdo de las partes, a un árbitro o a un Tribunal de varios árbitros que dicta un decisión sobre la controversia que es de obligatorio cumplimiento para las partes.
